The Website is owned and operated by Covenant Maravi (Canada) Systems Ltd, a company incorporated in Ontario, Canada (“we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Website and all related products and services, including dedicated servers, bare metal servers, colocation, and hosting services (collectively, the “Services”).
By placing an order or using our Services, you agree to be bound by these Terms.
If you do not agree, you may not access or use the Services.
1. Service Overview
RackandRoll.ca provides dedicated servers, bare metal servers, and related hosting, colocation, and network services.
All Services are provided “as is” and “as available”, unless otherwise expressly stated in a written service agreement.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.
2. Account and Eligibility
You must be at least 18 years old to use our Services.
You are responsible for maintaining the confidentiality and security of your account credentials.
You agree that all information provided during registration and ordering is accurate, complete, and kept up to date.
You are fully responsible for all activities conducted under your account, including activities by any third party accessing the Services using your credentials.
3. Acceptable Use Policy
You agree not to use the Services for any unlawful, abusive, or harmful purpose, including but not limited to:

Hosting or distributing malware, phishing, spam, or fraudulent content

Launching or participating in DDoS attacks or other network abuse

Storing or distributing illegal materials, including copyrighted or prohibited adult content

Cryptocurrency mining or high-intensity compute workloads unless explicitly authorized in writing

Interfering with, overloading, or disrupting our infrastructure or other customers’ services
Violation of this Acceptable Use Policy may result in immediate suspension or termination of Services without refund.
4. Payment and Billing
All Services must be paid in advance prior to activation.
Payments are accepted via PayPal and other payment methods displayed at checkout.
Failure to complete payment by the due date may result in suspension, termination, or data deletion.
All fees are non-refundable, except as expressly stated in our Return and Refund Policy.
Prices may change at any time; however, changes will not affect active subscriptions until the next renewal period.
5. Service Availability and Maintenance
While we aim to provide reliable and high-availability Services, we do not guarantee uninterrupted or error-free operation.
Downtime may occur due to scheduled maintenance, hardware failure, upstream provider issues, or force majeure events.
We are not responsible for downtime or service interruptions caused by:

Third-party network or transit providers

Cyberattacks, natural disasters, or events beyond our reasonable control
6. Data and Backups
You are solely responsible for maintaining independent backups of your data.
Covenant Maravi (Canada) Systems Ltd and RackandRoll.ca are not liable for any loss of data resulting from service interruption, hardware failure, system maintenance, or user error.
7. Cancellation and Termination
You may cancel your Services at any time prior to the next billing cycle.
No refunds or credits will be issued for unused time or partial billing periods.
We may suspend or terminate your Services, with or without notice, if:

Payment is overdue or reversed

You engage in fraudulent, abusive, or illegal activities
8. Limitation of Liability
To the maximum extent permitted by applicable law:
RackandRoll.ca and Covenant Maravi (Canada) Systems Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the Services.
Our total cumulative liability for any claim shall not exceed the total fees paid by you for the affected Services in the 30 days preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Covenant Maravi (Canada) Systems Ltd, its directors, officers, employees, and partners from any claims, damages, losses, or expenses arising out of:

10. Governing Law and Jurisdiction
